Realenza

Realenza — Terms of use

Last updated: 26 October 2026

Realenza is a closed business-to-business platform on which licensed real-estate agencies publish the properties they hold a mandate for, and licensed brokers find those properties for their own buyers. It is not a public property portal and it is not open to consumers.

These terms of use ("Terms") govern access to and use of the platform. They form a binding agreement between the operator of Realenza ("Realenza", "we", "us") and the company that registers ("Member", "you"). By submitting a registration and by using the platform afterwards, the Member accepts these Terms for itself and for every user account created under it.

1. Scope and acceptance

These Terms cover the whole platform: the agency portal, the broker portal, the client-facing pages a broker generates for its own clients, the Partner API, and every e-mail the system sends in connection with them.

The platform is offered exclusively to businesses, in the course of their professional activity. It is not a consumer service, it is not made available to private buyers or sellers, and the provisions of consumer protection law do not apply to the relationship between Realenza and a Member.

The privacy policy forms part of these Terms. Where a Member and Realenza sign a separate membership, annual plan or Partner API agreement, that agreement prevails on the points it settles; these Terms continue to apply to everything else.

If a Member does not accept these Terms, it must not register and must not use the platform.

2. Definitions

Platform
The Realenza application and all its parts: the agency portal, the broker portal, the administration, the client-facing share pages and the Partner API.
Member organization (Member)
The company registered on the platform as an organization. A Member may hold the listing-agency role, the broker role, or both. The account belongs to the company, not to any individual.
Listing agency
A Member acting in its capacity as the agency that publishes a listing on the basis of its own mandate.
Broker
A Member acting on the side of a buyer or tenant, searching the network for its own client.
User
A named individual account created within a Member. The first user registered becomes the organization administrator.
Listing
The record of one property published by a listing agency, including its texts, attributes, price, location data, mandate and commission data, photographs and video.
Client link
The read-only page a broker generates for its own client — for a single listing (an address under /s/) or for a selection of listings (an address under /c/).
Location grant
A permission issued by a listing agency to one other Member organization to see the exact address and coordinates of one listing.
Partner API
The read-only interface under /partner/v1 through which a Member may retrieve listing data with an API key.
Pilot period
The introductory period during which the platform is provided free of charge (section 14).

3. Eligibility, registration and verification

Registration is made by a company, not by an individual. The person registering warrants that they are authorised to bind that company.

By registering, the applicant warrants that it is a licensed real-estate brokerage — in Croatia, that it is entered in the official register of real-estate brokerage agencies kept by the Croatian Chamber of Economy (HGK); elsewhere, in the equivalent official register of its country.

Every registration is checked manually against that register before access is granted. Verification normally takes one to two business days, and signing in is not possible until the organization is approved. We may refuse a registration without giving reasons, and we may ask for evidence of the licence at any time.

Approval is a formal check that the applicant is a real, registered business that appears in the relevant register. It is not an endorsement, certification, audit, recommendation or guarantee — of the applicant, of its listings, of the truthfulness of anything it publishes, of its solvency or of the quality of its services. Nothing in the approval makes us responsible for what an approved Member subsequently publishes or does.

The Member keeps its company data — name, VAT number or OIB, court register number, brokerage-register number, address and contact details — accurate and up to date. The Member informs us without delay if its licence expires, is suspended or is withdrawn. Loss of the licence ends eligibility and we may suspend the organization immediately.

The company data from the registration — name, legal form, address, VAT number or OIB, company registration number, brokerage-register number, e-mail, phone, website and logo — is visible to other active Members in the member directory: agencies see brokers, and brokers see agencies.

4. Accounts and responsibility for users

User accounts are personal and non-transferable. Credentials must not be shared, lent, sold or otherwise made available to anyone else, whether inside or outside the Member organization. Every person who uses the platform needs their own account.

The Member is responsible for everything done under its accounts — by its employees, agents and contractors — as if it had done it itself. The organization administrator creates and removes users, and must deactivate accounts of people who leave or change role, without delay.

The Member must notify us without delay if it suspects that a credential, session or API key has been compromised.

We may block an individual account, or require a password reset, where there are reasonable grounds to suspect misuse.

5. What Realenza is, and what it is not

This section describes the division of responsibility on which the whole platform rests. It is the most important section of these Terms.

Realenza is an information society service. We store information supplied by our Members and make it available inside a closed professional network, so that licensed agencies and brokers can find each other and cooperate. Every listing is published by the listing agency, on its own behalf and on its own responsibility.

We are not a real-estate agent or broker. We accept no mandates from owners, we do not negotiate, we do not prepare or conclude contracts of sale or lease, we do not show properties, and we have no contact with owners, buyers or tenants.

We are not a party to any transaction, cooperation agreement or commission arrangement between Members. Commission and its split are agreed strictly bilaterally between the listing agency and the broker. The commission published on a listing is the listing agency offer to the network — not our offer, not a term we set, and not something we verify, mediate or enforce.

We take no share of any commission. We receive no success fee, no finder fee and no payment that depends on a transaction taking place. Our fees are charged for access to the platform and the distribution of information only (section 14).

We do not handle client money. No deposits, purchase prices, rents or commissions pass through us; we operate no escrow, payment or trust account.

In relation to the content Members publish, we act as a hosting service in the sense of the European rules on intermediary services (Directive 2000/31/EC on electronic commerce and Regulation (EU) 2022/2065 on a single market for digital services). In plain language: we do not check listings for truthfulness, legality or accuracy before they are published, and we have no general obligation to monitor what Members publish. When we obtain actual knowledge that content is unlawful or manifestly untrue — through a report under section 16, an order of a competent authority, or otherwise — we act promptly to remove it or disable access to it.

The checks the system does perform before a listing can be published — that the mandate has been confirmed, that a price or "price on request" is set, that at least one photograph exists, that a location has been placed — are technical publication requirements. They do not make the content ours and they are not a verification that the content is true.

6. Obligations of the listing agency

A listing agency publishes on its own behalf and is solely responsible for the accuracy, completeness, legality and currency of everything it publishes — texts, prices, attributes, location data, mandate and commission data, photographs and video.

For every listing it publishes, the listing agency warrants that:

  • it holds a valid written brokerage agreement (mandate) with the person entitled to dispose of the property, covering advertising of the property and cooperation with other agencies — the confirmation ticked in the "Mandate and commission" section of the listing form is that warranty;
  • the mandate type stated on the listing (exclusive or non-exclusive) and its validity date are correct;
  • the property is genuinely on the market on the stated terms, and the stated price is the price the agency is authorised to advertise;
  • it holds all rights needed to publish the photographs, video and texts and to grant the licence in section 13, including the rights of the photographer and the consent of any identifiable person shown;
  • publication does not infringe the rights of any third party and complies with the law applicable to it, including advertising, energy-certificate and data protection rules.

The listing agency must not enter the name, contact details or other identifying data of the owner or of any other individual into the listing content. The listing fields are designed so that this is never necessary.

Currency of the listing is a condition of membership, not a courtesy. The platform asks the agency to confirm availability at regular intervals: a reminder is sent 25 days after the last confirmation, a listing not confirmed for 35 days is marked as stale and drops out of the default search, and a listing not confirmed for 60 days expires automatically. Independently of that rhythm, the agency enters every change of status — reserved, sold, withdrawn — without delay, and in any event within 48 hours of learning of it.

The commission published on a listing binds the listing agency towards a broker who relied on it and introduced a client while it was published. Any dispute about it is a matter between the two Members (section 5).

7. Obligations of the broker; no circumvention

A broker may present another Member listing to its own clients only through the sharing mechanism of the platform — a client link under section 9. Screenshots, exported files, copied texts, forwarded portal links and re-publication elsewhere are not permitted.

A broker must not disclose to a client or to any third party, in relation to another Member listing:

  • the identity of the listing agency;
  • the co-broke commission, its percentage or the terms attached to it;
  • the mandate or its type;
  • the street address or the exact coordinates of the property, including an address obtained through a location grant.

A broker must not contact the owner of another Member property, approach the property or its occupants, or use any information obtained on the platform, in order to bypass the listing agency, to obtain a mandate for itself, or to conclude the transaction outside the cooperation the platform is designed to support.

The prohibition on circumvention continues to apply for [24] months after the Member last accessed the listing concerned, and survives termination of membership.

A breach of this section is a material breach. It leads to immediate suspension and, where the listing agency suffers loss, to liability for that loss under general Croatian law of obligations.

8. Location data, and the rules for revealing it

The platform protects listing agencies from being bypassed by controlling how precisely a property can be located.

By default, another Member sees only an approximate location: the coordinates are snapped to a grid and presented as a circle of 800 metres, and the street address is not shown at all. The same applies to the Partner API network feed.

There are exactly two exceptions:

  • Public exact location — where the listing agency holds an exclusive mandate and itself chooses to publish the exact location to the whole network. This is the agency own decision, made on the listing.
  • Location grant — the listing agency unlocks the exact address and pin for one other Member organization, for one listing, from inside the inquiry thread with that Member. A grant is intended to be issued after the two have signed a cooperation agreement. It applies to the whole grantee organization but only to that one listing, and the listing agency may revoke it at any time. The grant and its revocation are written into the thread as a system message and recorded in the audit trail, which is kept for twelve months (section 11 of the Privacy policy).

A location grant never changes what the client-facing pages show, and it is invisible to the Partner API.

An exact location obtained in either way is confidential information of the listing agency. Using it — or any address, coordinate or other identifying detail obtained on the platform — to bypass the listing agency, to contact the owner, or to pass on to a client or third party, is a material breach of these Terms and grounds for immediate suspension, in addition to liability for any loss caused.

Members must not attempt to defeat the approximation: no cross-referencing against other portals, registers or map services in order to re-identify the address, no narrowing of the circle, and no inference of the exact position from photographs or description text.

9. Client links

A client link is a read-only web page, carrying the broker own branding and contact details, which the broker generates for one listing or for a selection of listings and sends to its own client. It requires no account: anyone who has the address can open it. The pages are excluded from search-engine indexing.

What a client link never shows is fixed by the system, not by a setting: the identity of the listing agency, the commission, the mandate, and the exact address or coordinates. The street address appears only where the broker enables it and the listing is either the broker own or an exclusive listing whose agency publishes the address to the whole network.

A link is valid for a period the broker chooses between 1 and 180 days, 30 by default. The broker may revoke a link at any time; revocation takes effect immediately and cannot be undone. Once expired or revoked, the page no longer opens.

Because a link works for anyone who holds it, the broker treats it as confidential: it chooses a sensible validity period, sends the link directly to the intended client, and revokes it when the matter is closed. The broker is responsible for what it shares, to whom it sends a link, and for the consequences of the recipient forwarding it onward.

Openings of a client link are counted, and the broker sees how many times and when the page was opened (section 10).

Photographs on client-facing pages carry a watermark. Removing, cropping out, obscuring or overlaying the watermark, and presenting the material as the broker own work, are prohibited.

10. Audit trail, counters and automatic protection

The platform records security-relevant events: sign-ins, listing views, inquiries, creation and revocation of client links and of location grants, creation and revocation of API keys, and administrative actions. Each record holds the acting user, the organization and role, the action, the record concerned, the time, the IP address and the browser identification.

Listings carry counters — how many brokers opened them, how many client links were generated, how many inquiries were raised. Listing agencies and brokers see these counters inside the platform, and the client-facing page shows an aggregate figure. The counters are aggregate: no Member ever sees the identity of another Member client.

Members accept this recording as a condition of access. It exists to protect the network: to detect bulk extraction, to establish who revealed what when a dispute arises, and to meet our own legal obligations.

Access patterns that indicate automated or bulk retrieval may be throttled, blocked or suspended automatically. Sign-in attempts and certain public endpoints are rate limited.

11. Acceptable use

A Member must not, and must not permit anyone else to:

  • scrape, crawl, index or otherwise harvest listings, media or any other data by automated means, or download them in bulk, outside the Partner API and the scopes granted to it;
  • reverse engineer the platform, circumvent access controls, rate limits or the location approximation, or probe for records it has not been shown;
  • share, publish, sell or transfer credentials or API keys, or give access to a person or organization that is not a verified Member;
  • resell, syndicate, license or otherwise redistribute platform data, or build a database, an index or a derived data product from it;
  • use platform data to build, feed or improve a competing listing service, a data set offered to third parties, or a machine-learning model;
  • use the platform to contact the clients or the property owners of another Member other than through the cooperation the platform provides;
  • upload unlawful, infringing, misleading, defamatory or harmful content, malicious code, or content that violates the rights of any person;
  • misrepresent its licence status, impersonate another organization, or register on behalf of an organization it is not authorised to represent;
  • use the platform in breach of any law applicable to it, including real-estate brokerage, advertising, competition, anti-money-laundering and data protection rules.

Each Member remains itself responsible for its own regulatory obligations, including anti-money-laundering duties. Realenza is not a broker and is not an obliged entity under those rules; membership does not transfer any regulatory duty to us.

12. Confidentiality

Everything visible inside the closed portal but deliberately absent from the client-facing pages is confidential information of the Member it belongs to. This includes in particular the identity of the listing agency for an individual property, commission percentages and notes, mandate data, exact addresses and coordinates, the content of inquiry threads, and the composition of the network inventory.

A Member may use that information only for the purpose for which the platform makes it available — evaluating and pursuing cooperation on a specific property — and may disclose it only to its own users who need it for that purpose, on the same terms of confidence.

These obligations apply for the duration of membership and for three years after it ends.

13. Content, licence and intellectual property

A Member retains all rights in the content it publishes.

By publishing content, the Member grants Realenza a non-exclusive, royalty-free licence — for the duration of its membership and the retention periods that follow it — to store that content, to reproduce it, to adapt it technically (resize, re-encode, watermark, remove embedded metadata), to translate it, to index it and to display it within the platform: to other Members, on client links generated by Members, and through the Partner API within the scope granted. The licence covers the operation of the platform only. We do not use member content in our own advertising without separate written consent.

When a listing is withdrawn, sold or expires, it stops being distributed: it disappears from search, from the network and from the Partner API. Copies already retrieved through the Partner API must be removed by the recipient in line with the data-hygiene rules in section 15.

The platform itself — its software, design, structure, texts, brand, logo and partner badges — belongs to Realenza or to its licensors. The compilation of listings constitutes a database in which we assert database rights. Extraction or re-utilisation of a substantial part of it, and repeated extraction of insubstantial parts, are prohibited.

A Member on an annual plan is granted, and undertakes, to display the Realenza partner badge on its own website as supplied: without altering its colours or proportions and without removing the link. That licence ends with the annual plan.

Suggestions and feedback a Member sends us about the platform may be used freely and without compensation.

14. Fees and payment

During the pilot period the platform is free of charge for every Member: unlimited listings, both portals, client links and the full search. No card is required, nothing renews automatically, and no charge arises when the pilot ends. The pilot period is set for each organization when it is approved; the standard length is twelve months.

After the pilot, a listing agency chooses one of three models:

  • Per property — 100 EUR + VAT, one-off. A single payment when the listing is published; the listing stays until it is sold or withdrawn, whether that is five days or five years. No monthly or annual fee.
  • Silver partner — 5,000 EUR + VAT per year. An unlimited number of listings through the year, plus partner status and the partner badge.
  • Golden partner — 8,000 EUR + VAT per year. Everything in Silver, plus access to the Partner API.

Buyer-side broker access is free of charge and remains so.

Payment is by bank transfer against an invoice only. We accept no cards and use no payment service provider, and we therefore never hold any payment credentials of a Member.

Prices are stated without VAT. VAT is added at the applicable rate; for a business established in another EU member state and holding a valid VAT identification number, the reverse-charge mechanism applies where its conditions are met.

Invoices are payable by the due date stated on the invoice. Where an invoice remains unpaid after a written reminder, we may suspend the publication of new listings until it is settled.

Prices may change, and the introduction of a fee after the pilot is such a change. Every change is announced at least 60 days before it takes effect, in the platform and by e-mail to organization administrators. A Member that does not accept a change may terminate before it takes effect. A one-off per-property fee already paid is not affected by any later price change.

Fees already paid are not refunded, except where these Terms (section 18) or mandatory law provide otherwise.

Partner status — Silver or Golden — is granted and withdrawn by the platform administrator, and is recorded in the audit trail. Because payment is made by bank transfer outside the system, status is not an automatic consequence of a payment.

15. Partner API

The Partner API is a read-only interface that lets a Member display listing data outside the portal, typically on its own website. It is sold as part of the Golden partner plan or as a separate product, and it is enabled by the administrator.

API keys are created by organization administrators in the portal. A key is displayed once and stored by us only as a hash — nobody, including us, can read it afterwards. The Member keeps its keys on its own server, never in browser JavaScript, is responsible for everything done with them, and revokes a leaked key immediately.

Each key carries scopes. The own scope returns the Member own listings in full. The network scope returns the client-facing shape only: without commission, without the identity of the listing agency, without the mandate, without the street address, with approximate coordinates and with watermarked photographs. What the network shape omits is omitted by design and must not be reconstructed.

Fair use is enforced through per-key rate limits (60 requests per minute by default) and daily usage metering, not through per-request billing. Exceeding the limit returns an error and requires the client to back off.

The data-hygiene rules published in the Partner API documentation are contractual terms: show only listings that are in the current feed, refresh at least daily, never expose or infer the omitted data, respect the watermark, state Realenza as the source, keep the key server-side, cache politely, and do not redistribute the feed to third parties without a separate agreement.

We may suspend or revoke an individual key, or every key of an organization, with immediate effect in the event of abuse, a security incident, or a breach of the rules in this section. Keys stop working while the organization is suspended.

The Partner API is versioned by path. Additive changes may be made at any time; a breaking change is released under a new version path with a migration window.

16. Reporting content, and what we do about it

Anyone — a Member, a property owner, an authority or any third party — may report a listing they consider unlawful, infringing or untrue, by writing to info@realenza.com. A report should identify the listing (its reference code or link), explain the problem, and give contact details for follow-up.

We examine substantiated reports promptly. Depending on what we find, we may ask the listing agency for evidence of its mandate or of its rights in the content, suspend the listing while we examine it, remove the listing, or suspend the organization.

We inform the listing agency of the measure taken and the reason for it, and the agency may respond. Our decision on whether content stays on the platform is final within the platform; it does not affect anyone rights before a court or an authority.

Repeatedly publishing listings without a valid mandate, or content that infringes the rights of others, results in termination of membership.

17. Suspension and termination

A Member may terminate its membership at any time by written notice to info@realenza.com. An annual plan runs to the end of the period already paid for and is not refunded pro rata; a one-off per-property fee is likewise not refunded.

We may suspend an organization or an individual user immediately, without prior notice, where:

  • the licence on which membership rests has expired, been suspended or been withdrawn;
  • the data given on registration turns out to be false;
  • credentials or API keys have been shared or otherwise misused;
  • there is circumvention, or unauthorised disclosure of a location, of the identity of a listing agency or of commission terms;
  • there is bulk extraction, scraping or another breach of section 11;
  • there is a security incident that makes suspension necessary to protect the network;
  • an invoice remains unpaid after a written reminder;
  • there is any other material breach of these Terms.

We may terminate for cause where a material breach that can be cured is not cured within fifteen days of written notice, and immediately where it cannot be cured. We may terminate for convenience on 60 days written notice.

On suspension or termination: signing in stops; the Member listings stop being distributed and disappear from search, from the network and from the Partner API; every client link generated by the Member stops working; and every API key of the organization stops resolving. Data we are required or entitled to keep — the audit trail, accounting records — is kept for the periods stated in the privacy policy.

Sections that by their nature are meant to continue — confidentiality, the prohibition on circumvention, intellectual property, liability, and governing law — survive the end of membership.

18. Changes to these Terms

We may amend these Terms, for example to reflect a change in the service, in our business model or in the law.

A material change is announced at least 30 days before it takes effect, in the platform and by e-mail to organization administrators. Continuing to use the platform after the effective date means the revised Terms are accepted.

A Member that does not accept a change may terminate with effect from the date the change takes effect. By way of exception to section 17, we then refund the unused part of any annual fee already paid, calculated pro rata.

The current version is always published at this address with its effective date. Superseded versions are available from us on request.

19. Warranties, liability and indemnity

The platform is provided as it is and as available. We do not warrant that it will be uninterrupted or free of error, that search results are complete, or that any listing is accurate, lawful, still available, or backed by a valid mandate. All warranties not expressly given in these Terms are excluded so far as the law permits.

We are not liable for the content, conduct, solvency or performance of any Member; for the outcome of any cooperation, transaction or commission arrangement between Members; for a Member failing to pay a commission it published; for the accuracy or legality of a listing; or for loss caused by another Member breaching these Terms.

We are not liable for indirect or consequential loss, lost profit, lost business opportunity, lost commission, loss of goodwill or loss of data.

Our total aggregate liability to a Member for all claims arising in any twelve-month period is limited to the fees that Member actually paid us for that period, and where no fees were paid — during the pilot period or for free broker access — to 1,000 EUR.

These limits do not apply to liability that cannot be limited under Croatian law, in particular liability for intent or gross negligence, and liability for injury to life or health.

The Member indemnifies Realenza against claims of third parties — including owners, clients, other Members and authorities — arising out of content the Member published, out of its breach of these Terms, or out of its breach of the law, and against the reasonable costs of defending such claims.

Neither party is liable for a failure to perform caused by an event beyond its reasonable control, including power or network failures, failures of infrastructure providers, natural events, war and acts of authorities.

20. Data protection

How we handle personal data is described in the privacy policy, which forms part of these Terms.

In short: for accounts, membership administration, invoicing and the security of the platform, Realenza is the controller. For the content a Member publishes and the messages it writes, the Member decides what goes in and is the controller of any personal data it chooses to include; it warrants that it has a legal basis for it. Where the roles of the parties require it, the data protection terms required by Article 28 of the GDPR are settled in the membership agreement.

The end client of a broker never enters the platform: the broker sends the client link itself, outside the system, and we neither collect nor receive the identity of that client.

A Member must not upload special categories of personal data, and must not enter into listing content the personal data of owners or of any other individual.

21. Governing law, jurisdiction and language

These Terms and any dispute arising out of them or out of the use of the platform are governed by the law of the Republic of Croatia, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.

The parties will first try to settle any dispute amicably; either party may take the matter further 30 days after raising it in writing.

For any dispute that cannot be settled amicably, the court having jurisdiction at the seat of the operator, in [Split], Croatia, has exclusive jurisdiction. As the platform is used exclusively by businesses, the rules on the consumer forum do not apply.

These Terms are published in Croatian and in English, and are displayed in English in the other interface languages for convenience. The Croatian version is the legally binding one; if the versions diverge, the Croatian text prevails.
